Technical-Normative Update Details

The substances covered by the Regulations below are the subject of the update.

The EU Commission has published in the OJEU L 379 of November 13, 2020 three new Regulations, already approved last June, which specifically are:

• Regulation (EU) 2020/1682 del 12 novembre 2020 amending Annex III of Regulation (EC) n. 1223/2009, in entries 313 and 314, authorizing the use of HEMA and Di-HEMA in nail products for professional use only with the requirement to label specific restrictions ("for professional use only" and "May cause an allergic reaction"), with the following timelines for compliance: as of June 3, 2021, no products containing these substances and not complying with the restrictions shall be made available on the Union market; as of September 3, 2021, no products containing these substances and not complying with the restrictions shall be made available on the Union market.
• Regulation (EU) 2020/1683 of November 12, 2020 (with corrigendum published in the OJEU of November 26, 2020) amending Annexes II and III of Regulation (EC) No 1223/2009. In detail, in Annex II the entries from 1642 to 1644 are inserted, corresponding to three substances that, on the basis of the opinions of SCCS, are banned for hair and eyelash coloring with the following adaptation timeframes: from 3 September 2021 no hair and eyelash dyes containing these substances are placed on the Union market; from 3 June 2022 no hair and eyelash dyes containing these substances are made available on the Union market. On the other hand, in Annex III item 292 is modified, with the extension of the use of the substance also in products for professional use for eyelash dyeing, and items 315 to 320 corresponding to six hair dyes are inserted, with the obligation to report specific warnings on the label starting from December 3, 2021.
• Regulation (EU) 2020/1684 of November 12, 2020 amending Annex VI of Regulation (EC) no. 1223/2009 with the inclusion among the allowed UV filters, under item no. 32, of Methoxypropylamino Cyclohexenylidene Ethoxyethylcyanoacetate at a maximum concentration of 3%.
